Dispute Resolution

If any disagreement or claim arises from this Agreement or the use of our services or this website, it must be resolved through BINDING ARBITRATION under the American Arbitration Association's administration. The only exception to this rule is that you may file an individual claim in a small-claims court with proper jurisdiction. Regardless of your choice, you are not permitted to initiate or participate in any class action, class arbitration, or similar legal proceedings against us.

By accessing our website or services, you acknowledge and accept this arbitration clause, thereby waiving your right to pursue legal action in court, except for matters within small-claims court jurisdiction. Additionally, you forfeit your right to be part of a class-action lawsuit. Arbitration ensures a neutral arbitrator, not a judge or jury, will oversee the case, and the process is typically more streamlined than court trials. Arbitration decisions are legally binding and enforceable in court, with limited grounds for appeal.

If you need to enforce this arbitration agreement, including confirming, modifying, or vacating an arbitration award, you may initiate proceedings in an appropriate court. Should this arbitration clause be deemed unenforceable, any resulting litigation (excluding small-claims court cases) must occur in a federal or state court in San Francisco, California. You irrevocably consent to the jurisdiction of these courts. This Agreement and any related disputes shall be governed by California law, excluding conflict-of-law principles. However, the arbitration agreement itself is governed by the Federal Arbitration Act. If legal action is taken to enforce this Agreement, the prevailing party is entitled to reimbursement for reasonable legal fees, court costs, and associated expenses.

To opt out of the arbitration agreement, you must submit a written request via email to support@booksmarticket.com within 30 days of first accepting these terms.

If you find an identical itinerary with a lower price from a competitor within 24 hours of booking with us, provide us with their complete itinerary details, including fare basis and fare calculations. We will match the fare and reward you with a $50 travel voucher for your next bulk fare booking with us.

Advertised Fare Commitment

We stand by the availability of the fares advertised on our website for the specified travel periods. If an advertised fare is unavailable, BookSmartTicket.com will honor the fare at the advertised price.
